Course Description

This presentation is a refresher for attorneys to illustrate (from the expert’s perspective) the relationship between the attorney and expert in accident analysis and investigation. Attorneys practicing personal injury or product liability law frequently employ technical experts to assist with the engineering and scientific issues of their cases. Knowledge of the expert’s process and the resources experts use to produce the highest quality work can lead to much more effective development and use of the expert’s testimony.

When your Product goes to work: Occupational Safety & Health in Product Liability Cases

When a workplace injury or fatality involves a product, both the conduct of the employer and the conduct of the product manufacturer are often scrutinized. Worker’s compensation laws forbid most injured workers from suing their employers, but claims against manufacturers of products used in the workplace are common. Such claims often raise complex questions about interactions between the product, the workplace, and the workers. These questions can involve product design, usability, marketing, warnings, instructions, and maintenance requirements, as well as workplace safety management systems (SMSs). Issues involving SMSs specifically include, but are not necessarily limited to, policies, procedures (e.g., for operations, maintenance, and emergency response), and other administrative controls, (e.g., checklists and permits); employee and contractor training; enforcement of safety rules and procedures; and contractor management issues.

This presentation will discuss how human factors professionals with expertise in occupational safety and health can evaluate the conduct of employers, workers, contractors, and product manufacturers in these contexts. Additionally, illustrative case studies involving industrial equipment, control software, and chemical products will be reviewed.

Employment Law (60 min) – Panel Discussion with employee- and employer-side lawyers on recent trends in employment law.  “Interview with Plaintiff’s Counsel” where we will walk through a hypothetical case involving a prospective employee/plaintiff and their initial interview with a plaintiff’s employment lawyer and will also discuss recent trends and case patterns seen by plaintiff’s employment lawyers.

Construction Law (90 min)
Rapid Response to Failures During Construction.
Construction is an inherently high-risk industry; jobsites are hazardous to personnel and structures are most vulnerable when they are in the process of being built, renovated, or demolished. When construction failures and accidents occur, the consequences are often severe, including worker casualties and costly project delays. Timely response to an incident is also critical, as quickly changing site conditions can often obscure key evidence. This presentation will discuss the role of the forensic engineer and construction attorney in responding to construction failures. The importance of mobilizing for rapid response, collecting evidence (using a variety of methods such as simple observations, photographs, laser scanning, and drone flights), and applying the scientific method to draw legitimate and defendable conclusions will be discussed. Lessons learned will be shared to help attorneys who represent design professionals, contractors, and owners be prepared for these high consequence events.

Construction litigation cases potentially require multiple experts, and attorneys face ever increasing pressure to manage cases in an efficient and cost-effective manner. This presentation outlines several typical construction litigation case studies, and examines the question of what types of experts are potentially needed and how they may be best utilized during the litigation process.
