Nuclear Verdict Reversed

On June 11, 2024, the Indiana Court of Appeals issued its decision in Abbas v. Neter-Nu. The appeal involved a trial of a medical malpractice case.  The Court overturned a verdict in favor of the plaintiff (represented by Cohen & Malad) for eleven million dollars and remanded the case for a new trial. The Court of Appeals agreed with the defense (represented by O’Neill McFadden & Willett, LLP) that the trial court judge made multiple errors which were cumulative and not harmless. The Court of Appeals found that the trial court judge erred regarding various jury instructions, in limiting references to medical records, in limiting impeachment of a plaintiff’s expert and in denying a motion for directed verdict to the hospital.
